PRIVACY POLICY

LAPOINTE AUTOMOBILES INC., doing business as Lapointe Chrysler (hereinafter the "Dealership" or "we"), informs you about how we use the information we collect when you visit our website, social media platforms or applications, as well as when you register for our services (hereinafter the "Site"). Third-party websites accessible through hyperlinks from the Site are not part of the Site and are governed by their own policies.
This Privacy Policy (hereinafter the "Policy") sets out how we collect, use, disclose and process the information you provide to us, in accordance with the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1), as amended by Law 25.
This Policy applies to information collected through the Site as well as information collected in connection with the purchase, lease, financing or servicing of a vehicle at the Dealership.
By using our Site, you acknowledge that you have read this Policy. The collection, use and disclosure of your personal information remain subject to obtaining your consent in accordance with the "Consent" section below.
WHO IS RESPONSIBLE FOR YOUR INFORMATION
The Dealership is a separate legal entity and a member of the Groupe Ouellet network. It is the organization responsible for the personal information ("PI") contained in your customer file.
Groupe Ouellet Inc. and its technology partners, including D2C Media Inc., act as service providers for the hosting, management and optimization of the Site. They process certain PI on behalf of the Dealership under written agreements that limit the use of such PI to the intended purposes, prohibit its retention beyond those purposes and provide for appropriate measures in the event of a privacy incident.
Vehicles presented on the Site may also appear on the Groupe Ouellet network's collective platform (vehiculesgroupeouellet.ca). When you submit a request through this platform, it is forwarded to us and this Policy applies upon receipt.
The person responsible for the protection of personal information at the Dealership is identified in the "Person Responsible for the Protection of Personal Information" section below. You may also submit your requests to the person designated by Groupe Ouellet Inc., who acts as the point of contact for the entire network and forwards requests to the appropriate Dealership.
PERSONAL INFORMATION
What does "Personal Information" mean and how is it collected?
PI is information concerning an identifiable individual. We collect it when you register for our services, request information, subscribe to newsletters, participate in contests or loyalty programs, or purchase, lease, finance or service a vehicle, whether through an online form, a paper form or at the Dealership.
Depending on the service requested, PI collected may include your contact information (first and last name, address, email address and telephone number); information relating to the vehicle you are interested in and your preferences; and, when you apply for financing or leasing, financial information such as your employment status, income, type of residence and information required to assess your credit application. Financial and credit information is collected only for the purposes of an application submitted by you and with your express consent, in accordance with the "Sensitive Information" section.
You may choose not to provide the requested PI. However, we may then be unable to provide the requested service.
To respond to your requests and direct you to the appropriate service, we may also collect your geolocation data.
Our servers may also collect your device's IP address and the name of your Internet service provider. In most cases, this information constitutes Browsing Data and is processed in accordance with the "Browsing Data" section below.
How is PI used?
The collection of PI allows us to: (a) provide our services, including those related to the purchase, lease, financing or servicing of a vehicle; (b) offer and direct you to services that are more relevant to your needs; (c) improve and personalize the content, interface and features of the Site; (d) contact you to respond to your requests; (e) where you have consented, send you information, offers, advertising programs or promotional materials; (f) establish, maintain and improve our relationship with you; and (g) conduct audits and analyses necessary to maintain and improve our services.
Is PI shared with third parties?
We do not transfer, sell or disclose your PI to third parties without first obtaining your consent. Notwithstanding the foregoing, your PI may be disclosed:
(i) to Groupe Ouellet Inc. and its technology partners, including D2C Media Inc., as service providers acting on behalf of the Dealership pursuant to written agreements ensuring the confidentiality and security of such PI;
(ii) to other companies engaged by the Dealership to store or process such information on its behalf;
(iii) to financial institutions and financing or leasing companies where necessary to process a financing application submitted by you;
(iv) to the manufacturer whose products we distribute where necessary for the administration of a warranty, recall or maintenance program;
(v) to another dealership within the Groupe Ouellet network where the vehicle or service you are seeking is available and you have consented to such disclosure;
(vi) to our advertising partners and audience measurement platforms where you have provided consent through the Site's consent management tool.
The Dealership's membership in the Groupe Ouellet network and the ownership relationships between companies within the network do not, in themselves, constitute grounds for disclosing your PI.
Our service providers may use the services of providers located outside Québec. In accordance with Law 25, a privacy impact assessment is conducted before any transfer of PI outside Québec and a written agreement reflecting the findings of that assessment is entered into with the recipient.
We may also disclose PI in response to valid legal proceedings, such as subpoenas, search warrants and court orders, or to establish or exercise our legal rights or defend ourselves against legal claims.
We may disclose PI without your consent in connection with a business transaction (merger, acquisition or sale of assets), subject to compliance with the conditions prescribed by law. You will be notified prior to the transfer of your PI.
In-Dealership Collection and Loyalty Programs
We also collect PI at the Dealership. When you meet with one of our representatives, we may request your contact information, payment or financing information and any other information relevant to the purchase, lease or servicing of a vehicle.
When you join a loyalty program, you voluntarily provide us with certain PI, including your contact information, so that we can send you offers and rewards. This Policy applies to such information.
Do we receive PI from third parties?
When you use single sign-on services from our social media partners, including Facebook/Meta and Google, we may receive your email address and public profile information. If you wish to control this information, you must configure your privacy settings on the relevant social networks.
Our service providers may also use data management platforms to categorize Site visitors and provide more relevant advertising based on de-identified or pseudonymized data. Where such data, alone or combined with other information, can identify you, it is treated as PI, and its disclosure to a third party that uses it for its own purposes, including advertising, occurs only with your consent.
CONSENT
In accordance with Law 25, we collect your PI only with your clear, free and informed consent. Consent is requested for each specific purpose for which your PI is collected, used or disclosed. Consent is obtained separately and cannot be obtained through general terms of use.
You may withdraw your consent at any time by contacting our person responsible for the protection of personal information or by using the communication preferences form available on the Site.
Our commercial electronic messages are sent in accordance with Canada's Anti-Spam Legislation: they identify the sender, provide contact information and include a functioning unsubscribe mechanism. Unsubscribe requests are processed without delay and no later than 10 days after receipt.
COLLECTION OF PI FROM MINORS
In accordance with Law 25, personal information concerning a minor under the age of 14 may not be collected directly from the minor without the consent of the person having parental authority or the guardian, unless such collection is clearly for the minor's benefit.
HOW AND FOR HOW LONG IS PI RETAINED?
PI collected is stored on servers that are not accessible to the public and is protected by appropriate security measures against loss, theft, unauthorized access, copying, use or modification.
Access to PI is strictly limited to authorized employees, contractors and service providers who require access in the performance of their duties. These individuals are bound by confidentiality obligations.
We retain PI only for as long as necessary for the purposes set out in this Policy or as required by law. Retention periods are established in a retention schedule that takes into account applicable legal, tax and contractual requirements. As a general guideline, documents relating to a transaction, including financing documents, are retained for seven years following the end of the contractual relationship and are then securely destroyed or anonymized.
PRIVACY INCIDENTS
In accordance with Law 25, we maintain a register of privacy incidents involving PI. Any incident presenting a risk of serious harm is reported to the Commission d'accès à l'information du Québec and to the individuals concerned as soon as possible, and we take reasonable measures to reduce the risk of harm.
Where an incident affects the network's shared technology platform, Groupe Ouellet Inc. notifies us without delay and coordinates with us in assessing the risk and providing any required notices.
YOUR RIGHTS
Right of Access and Rectification
You may access PI concerning you or request that it be corrected by submitting a written request to our person responsible for the protection of personal information. We will process your request within 30 days of receipt, in accordance with the law.
Right to Data Portability
You have the right to obtain computerized PI collected from you in a structured and commonly used technological format. You may also request that this information be communicated to a person or organization authorized to collect it.
Right to Cessation of Dissemination and De-indexing
You have the right to request that dissemination of your PI cease or that any hyperlink associated with your name providing access to such information be de-indexed where such dissemination contravenes the law or a court order, or causes you serious harm in relation to your right to respect for your reputation or privacy, in the circumstances and subject to the conditions prescribed by law.
Decision Based on Automated Processing
Where a decision based exclusively on automated processing of your PI is made concerning you, for example an online financing prequalification, we will inform you no later than at the time the decision is made. Upon request, we will provide you with the PI used to make the decision, the reasons for the decision and the main factors and parameters that led to it, and we will inform you of your right to have the PI used corrected. You may submit your observations to a member of our staff who is able to review the decision.
Right to Withdraw Your Consent
You may withdraw your consent at any time. However, withdrawing your consent may prevent us from providing certain services.
BROWSING DATA
What does "Browsing Data" mean and how is it collected?
"Browsing Data" means data relating to your browsing activity or device. Examples include your IP address, browsing history, content of pages viewed, number of clicks, device type, the website from which you arrived and the website you visit after leaving ours, your approximate geographic location, and advertisements and videos viewed on the Site.
We do not use Browsing Data for the purpose of discovering your identity. However, certain Browsing Data, alone or combined with other information, may identify you, including your IP address or an identifier derived from your email address; in such cases, it is treated as PI.
Browsing Data is collected through cookies, which are small data files stored on your device when you browse the Site.
Who collects Browsing Data?
Browsing Data is or may be collected, in whole or in part, by the Dealership, Groupe Ouellet Inc. and its technology service providers, including D2C Media Inc., as well as by our advertising and audience measurement partners, including Google Analytics, Google Ads and Meta/Facebook.
Where collected data allows you to be identified, its disclosure to a partner that uses it for its own purposes, including advertising (for example, an identifier derived from your email address transmitted to an advertising platform), constitutes a disclosure of PI and occurs only with your consent, provided through the Site's consent management tool.
Except for cookies strictly necessary for the operation of the Site, no tracking, audience measurement or advertising cookies are activated before your consent has been obtained.
How is Browsing Data used?
This information is collected to allow us to: (a) generate statistical data regarding the performance and use of the Site; (b) improve your browsing experience; (c) provide advertising related to your interests where you have consented; and (d) ensure the technical maintenance of the Site and develop new services.
Categories of Cookies Used
The cookies we use fall into the following categories. Only strictly necessary cookies are enabled by default; all others are activated only with your consent and may be disabled at any time through the consent management tool.
Strictly Necessary
Necessary for the operation of the Site, for example to remember your privacy preferences, allow you to log in to an account or complete a form. They cannot be disabled in our systems and do not store any information that allows you to be identified.
Functionality
These cookies help improve and personalize certain Site features. If they are refused, some or all of these features may not function properly. Activated with your consent.
Performance and Audience Measurement
These cookies allow us to determine the number of visits and traffic sources in order to measure and improve the Site's performance. The reports we review are presented in aggregate form. However, certain underlying data, alone or combined with other information, may allow you to be identified; in such cases, it is treated as PI. Activated with your consent.
Targeted Advertising
These cookies are placed by our advertising partners to build a profile of your interests and provide relevant advertisements on other websites. They rely on an identifier associated with your browser or device and, where that identifier allows you to be recognized, are treated as PI. Activated with your consent.
Cookies may be temporary (deleted when the browser is closed) or persistent (retained to remember your preferences from one visit to the next).
Geolocation and Profiling
The Site may use geolocation features, including to direct you to the nearest location, as well as profiling features that allow advertisements and content presented to you to be tailored to your interests. You are informed of these practices through this Policy and the consent management tool. You may disable geolocation through your device or browser settings and profiling through the consent management tool or the settings described below.
How can you prevent the collection of your Browsing Data?
You may manage your cookie preferences at any time using the consent management tool integrated into the Site or, if unavailable, through your browser settings.
If you wish to disable Google Analytics or Google Ads advertising features, you may consult the Google Analytics Opt-out Browser Add-on or Google Ads settings. For Meta/Facebook features, please refer to your account settings.
If you choose to disable these cookies, you will still be able to access the information available on the Site. However, the Site will treat you as a new user each time you visit and only non-personalized advertising will be displayed to you.
SENSITIVE INFORMATION
Certain information is considered sensitive, meaning any information that, due to its nature or the context of its use or disclosure, gives rise to a high degree of reasonable expectation of privacy. This includes medical or biometric information as well as financial or credit information, such as information collected as part of a financing application.
Where sensitive information is collected, your express consent is obtained and the collection is limited to what is necessary for the intended purpose. No biometric process is used to verify or confirm your identity without your express consent and without complying with the formalities required by law.
You may refuse to provide us with sensitive information, in which case we may be unable to provide certain services.

Any complaint concerning the processing of your PI may also be submitted to this person. We will acknowledge receipt, review it diligently and provide you with a written response within 30 days of receipt. You may also file a complaint with the Commission d'accès à l'information du Québec if you believe your rights have not been respected.
VIDEO CONTENT AND THIRD-PARTY SERVICES
By interacting with YouTube videos embedded on the Site, users agree to be bound by YouTube's Terms of Service. Please also refer to Google's Privacy Policy.
CHANGES TO THIS POLICY
This Policy may be amended at any time. Any amendment will be posted on this page together with the date of the update. No amendment resulting in a reduction of your rights will take effect unless you have been given prior notice and your express consent has been obtained where required by law.
GENERAL
This Policy is governed by and interpreted in accordance with the laws in force in Canada and the Province of Québec, subject to mandatory provisions applicable to consumers. It must be read together with the Site's Terms of Use. This Policy was drafted in French. In the event of any discrepancy with a version in another language, the French version shall prevail to the extent permitted by law.
